Abstract

Medical confidentiality is a fundamental ethical duty in clinical practice, aimed at protecting patients' autonomy, privacy, and trust. However, in Chile, this principle is not absolute and includes exceptions when it conflicts with public health, the protection of minors, or serious risk to third parties, as established in Law No.20.584 and other applicable regulations. This article analyzes the bioethical conflict that arises between the duty of confidentiality and the obligation to prevent harm, examining. The criteria that justify limiting medical confidentiality from a perspective of proportionality. The analysis is based on the principles of autonomy, beneficence, non-maleficence, and justice, proposing a reasoned balance between respect for patients' rights and collective well-being. It concludes that medical confidentiality should be protected as a general rule but justifiably limited in exceptional situations.
