Resumen

En este trabajo se analizan los argumentos que Richard Posner y la escuela del análisis económico del Derecho han intentado proporcionar por más de cuarenta años en torno a la supuesta conducta maximizadora de los jueces y la aparente volución del Common Law en términos de eficiencia. Se abordan para ello los enfoques “normativos”, como también los “empírico-descriptivos” habituales en dicha escuela. En ambos casos, el esultado del análisis muestra las inconsistencias de las respuestas brindadas or Richard Posner y el análisis económico del Derecho.
