Abstract

The study is presented with a commentary on the Supreme Court's sentence of December 29, 2017, issued in Case No. 89,635-2016, which refers to the creation of civil liability for failure to comply with the duty of information on the part of an attending physician, within the framework of Law No. 20,584, which regulates the Rights and Duties of Persons in Relation to Actions Related to their Health Care. After a brief international news item, it describes the importance of the right to information to the patient in the field of health, its constitutional foundations, the legal asset protected, the national legal norms that contemplate it, the meaning of what should be understood as adequate information of the health personnel, the waiver of this right and the importance of the clinical record and the informed consent form, as a means of evidence.
